<p> You should try to Consumer Credit Counseling Services. They are a national organization that has existed since 1958. They are the largest nonprofit, full-service credit counseling agency in the United States. They have a debt management plan through Money Management International. http://www.moneymanagement.org/. To get started, will be interviewed in person, when talking about their situation. They are respected (although you Suze Orman like) and offer debt solutions at rates quite reasonable and are fixed to any bank or credit card companies. </p>

<p>Go back to the probate judge, you should not have to inherit anything, the house and car can be sold to pay the credit card bill.   After all assets are sold if there is remaining debt it just goes as unpaid, you do not have to pay it.</p>

<b>Help please, my wife and I are in dire straits now with our mortgage as I have recently lost my job?</b><br />

<p>I have not been out of work for at least 15 years and we have spent a substantial amount on our home to get it to the standard we want.<br />
The problem now is,I do not know what to do next. I am trying everything to get a new job, even looking into things that I have never done before. I feel totally responsible and somewhat ashamed that I have put us in this situation. I do not want to be in the position where we have to sell the house as we only have 10 years left on our mortgage. (I am 44 my wife is 36).<br />
Can anyone please give us advice as to what to do? Things are starting to get to a critical point. We do not qualify for any help from the government i.e. Council Tax relief, Mortgage relief etc, as my wife &#8220;earns too much&#8221;,which is rubbish.<br />
The only debt we have is one credit card, finance for one car and the usual monthly bills.<br />
Serious answers only please, I am near suicidal.

<p>Most mortgage companies will allow you a 6 month &#8216;repayment holiday&#8217; for reasons such as this so this is definitely the first thing you should do. </p>
<p>I assume you&#8217;ve been down to the jobcentre but if not make sure you do as you will qualify for Jobseeker&#8217;s allowance and will also be able to ensure your stamp for your NI contributions to safeguard full pension. They will also be able to help with advice of what other assistance may be available to you. </p>
<p>Make sure you got legal advice re the termination of your last job as to how much redundancy (if applicable) you should be entitled to.</p>
<p>Your wife may now qualify for tax credits, although this will depend on her earnings &#8211; the jobcentre should again be able to advise on this.</p>
<p>A re-mortgage is also an option. You could perhaps release £5k &#8211; £10k equity in your house to tide you over for 6 months or so. Better than selling the house anyway.</p>
<p>Try and find a temporary job whilst you look for some other work &#8211; even a few hours in tescos or a bar or go to a temp agency for an office job should help again to tide you over in the meantime.</p>
<p>Hope it works out, I know it must be rough.</p>

<b>Hypothetical Equity Line/Short Sale Question?</b><br />

<p>If someone is potentially facing a short sale but still has 30k left on an equity line, would it be possible for that person to use the 30k to pay off student loans and other debts with the equity line if they know they are already facing a short sale or foreclosure? Due to the Mortgage Forgiveness Debt Relief Act that was just enacted, a person would no longer have to pay tax on the debt forgiveness, so therefore the additional money used from the equity line would not be taxed.  Would it be smart to pay off student loans with this money if you already knew you would lose the house?<br />
Please no mean answers, I&#8217;m asking hypothetically if it would be possible to use this $$ without penalty.

<p>I think that the short sale approach assumes the debt is otherwise satisfied and that other liens (HELOC) are not existing.  The original holder would accept the short sale, the holder of the second (the HELOC) would want their money back.</p>
